SMS Gateway Policy

This SMS Acceptable Use Policy ("Policy") governs your use of the integrated SMS Gateway provided through the Plivonex SaaS ERP and POS platform, owned and operated by Ragu Farm (PVT) LTD ("Company", "we", "us", or "our").

By purchasing SMS credits or sending messages through the Plivonex platform, you agree to comply strictly with the rules outlined in this Policy.

1. SMS Credits and Billing

1.1 Separate Purchase: The SMS Gateway requires the purchase of SMS credits, which are billed separately from your standard ERP and POS branch subscriptions.

1.2 Non-Refundable: All purchases of SMS credits are strictly final and non-refundable. Unused credits cannot be exchanged for cash or applied toward your software subscription fees.

1.3 Pricing Adjustments: Ragu Farm (PVT) LTD reserves the right to adjust the pricing of SMS credits based on telecommunication provider rates. Any changes will be communicated in advance.

2. Consent and Opt-In Requirements

2.1 Explicit Consent: You may only send SMS messages to individuals who have explicitly opted in to receive communications from your business.

2.2 Transactional vs. Promotional: Transactional messages (e.g., billing receipts, order updates) may be sent to active customers. Promotional marketing messages must only be sent to customers who have specifically consented to marketing materials.

2.3 Opt-Out Mechanism: You must honor all opt-out requests immediately. If a customer requests to stop receiving messages, you must remove their contact number from your active Plivonex marketing lists.

3. Prohibited Content

You are strictly prohibited from using the Plivonex SMS Gateway to send:

3.1 Spam and Unsolicited Messages: Any form of bulk unsolicited messaging or spam.

3.2 Fraudulent or Misleading Content: Phishing attempts, scams, deceptive marketing, or misrepresentation of your identity.

3.3 Illegal or Harmful Material: Content that promotes illegal activities, hate speech, harassment, violence, or sexually explicit material.

3.4 Unlicensed Services: Promotion of gambling, adult services, or unapproved financial schemes.

4. Sender ID Guidelines

4.1 Accuracy: Any Sender ID used to transmit messages must accurately reflect your registered business name or the specific branch operating through Plivonex.

4.2 Spoofing: You must not use a Sender ID that misrepresents your identity or attempts to impersonate another individual, business, or government entity.

5. Compliance with Laws

5.1 Local Regulations: You are solely responsible for ensuring that your messaging practices comply with all applicable telecommunications regulations and anti-spam laws in the Democratic Socialist Republic of Sri Lanka, including guidelines set by the Telecommunications Regulatory Commission of Sri Lanka (TRCSL).

6. Violations and Suspension

6.1 Immediate Suspension: Ragu Farm (PVT) LTD reserves the right to monitor SMS usage for compliance. If we determine that you have violated this Policy, we may immediately suspend or permanently revoke your access to the SMS Gateway.

6.2 No Refunds for Violations: In the event of an SMS Gateway suspension due to a policy violation, any remaining SMS credits in your account will be forfeited, and no refunds will be issued.
